This Acceptable Use Policy ('AUP') governs the use of the FoxiFood platform operated by Elite Digital Services, LLC. This AUP is incorporated into and forms part of the Terms of Service. By using the Service, you agree to comply with this policy. Violation of this AUP may result in suspension or termination of your Account.

1. Permitted Use

The FoxiFood platform is designed exclusively for legitimate restaurant, food service, and hospitality businesses. You may use the platform to:

  • Create and manage an online ordering website for your restaurant or food service establishment;
  • Publish your menu, pricing, allergen information, and business details;
  • Accept and process food and beverage orders from your customers;
  • Process payments through the integrated payment gateway;
  • Manage customer accounts, order history, and notifications;
  • Generate QR codes for dine-in, takeaway, and delivery ordering;
  • Use the admin dashboard for analytics, order management, and business operations;
  • Connect your own custom domain to your ordering website.

2. Prohibited Activities

You may not use the FoxiFood platform to:

2.1. Illegal and Harmful Activities

  • Sell, advertise, or distribute illegal or prohibited products or substances;
  • Conduct any illegal business activities or facilitate illegal transactions;
  • Engage in fraud, money laundering, or any form of financial crime;
  • Facilitate tax evasion or create fraudulent invoices or receipts;
  • Operate a business that does not comply with local food safety, health, and hygiene regulations.

2.2. Content Violations

  • Publish false, misleading, or deceptive menu information, pricing, or allergen data;
  • Upload content that infringes on intellectual property rights of third parties (trademarks, copyrights, patents);
  • Publish content that is defamatory, obscene, offensive, hateful, or discriminatory;
  • Use stock photos or images without proper licensing;
  • Impersonate another business or misrepresent your business identity;
  • Đăng tải nội dung vi phạm luật quản lý nội dung áp dụng tại các khu vực pháp lý nơi bạn hoạt động (bao gồm, đối với Người dùng tại Liên minh Châu Âu, Đạo luật Dịch vụ Kỹ thuật số của EU (Quy định (EU) 2022/2065) và luật thực thi quốc gia liên quan);
  • Fail to respond to content complaints or notices from the Provider within the required timeframes set out in Section 5a of this policy.

2.3. Technical Abuse

  • Attempt to gain unauthorized access to the platform's systems, servers, or networks;
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform;
  • Use automated tools, bots, scrapers, or scripts to access the Service in a manner that exceeds normal use;
  • Distribute malware, viruses, ransomware, or other malicious software through the platform;
  • Perform denial-of-service attacks or intentionally degrade Service performance;
  • Exploit security vulnerabilities without responsible disclosure to the Provider;
  • Interfere with other Users' access to or use of the Service.

2.4. Misuse of the Platform

  • Use the platform for any non-food-service business without prior written approval;
  • Resell, sublicense, or share access to the platform with unauthorized third parties;
  • Use the platform for sending unsolicited messages (spam) or bulk communications;
  • Create multiple Accounts to circumvent usage limits, bans, or billing obligations;
  • Use the platform to develop, test, or operate a competing product or service.

3. Content Standards

All content you publish through FoxiFood must:

  • Be accurate, truthful, and not misleading;
  • Comply with applicable food safety, consumer protection, and advertising regulations;
  • Include accurate allergen information as required by applicable law;
  • Use only images and content you have the right to publish;
  • Not contain any hidden or deceptive elements.

You are solely responsible for the accuracy and legality of all content published through your ordering website. The Provider does not pre-review or verify User content.

4. Resource Usage Limits

To ensure fair access for all Users, the following resource limits apply:

  • Reasonable storage limits for menu images and media files;
  • API rate limits as documented in the Service documentation;
  • Email notification limits per Account per day.

Specific limits may vary by plan and are subject to change. The Provider will notify Users of any material changes to resource limits.

5. Monitoring and Enforcement

The Provider reserves the right to:

  • Monitor the use of the Service for compliance with this AUP;
  • Investigate reports of violations;
  • Issue warnings for minor or first-time violations;
  • Temporarily suspend access for investigation of potential violations;
  • Permanently terminate Accounts for serious, repeated, or willful violations;
  • Remove or disable content that violates this AUP;
  • Report illegal activities to the appropriate law enforcement authorities.

Where possible, the Provider will provide notice before taking enforcement action, except in cases of serious violations requiring immediate response (e.g., illegal activity, security threats, harm to other Users).

6. Notice and Action (Content Compliance)

Nhà cung cấp vận hành cơ chế thông báo và xử lý (notice-and-action) trên toàn thế giới để giải quyết nội dung bị cáo buộc là bất hợp pháp được lưu trữ trên nền tảng (đối với nội dung và Người dùng tại Liên minh Châu Âu, cơ chế này cũng nhằm thực thi Quy định (EU) 2022/2065 (Đạo luật Dịch vụ Kỹ thuật số)):

  • Bất kỳ cá nhân hoặc cơ quan nào cũng có thể gửi thông báo cho Nhà cung cấp về nội dung trên trang web đặt hàng của Người dùng mà họ cho là bất hợp pháp theo luật áp dụng đối với nội dung đó;
  • Upon receipt of a valid notice, the Provider will promptly notify the affected User and provide details of the complaint;
  • The User must respond to the Provider within 48 hours, either removing or modifying the content, or providing a substantiated explanation of why the content is lawful;
  • If the User fails to respond within 48 hours, the Provider reserves the right to restrict access to or remove the allegedly illegal content;
  • The User may contest the Provider's decision by submitting a counter-statement within 14 calendar days, explaining why the content should be restored;
  • The Provider will review counter-statements diligently and notify the User of its decision within 30 calendar days.

Repeated failure to respond to content notices or persistent publication of illegal content constitutes a serious violation of this AUP and may result in immediate suspension or termination of the Account.

7. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at: support@foxi.food

Please include a description of the violation, the Account or website involved (if known), and any supporting evidence. We will investigate all reports and take appropriate action.

8. Changes to This Policy

The Provider reserves the right to update this Acceptable Use Policy at any time. Changes will be communicated in accordance with Section 21.1 of the Terms of Service. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
