Acceptable use policy

This Acceptable Use Policy ('AUP') governs the use of the FoxiFood platform operated by Elite Digital Services, LLC. This AUP is incorporated into and forms part of the Terms of Service. By using the Service, you agree to comply with this policy. Violation of this AUP may result in suspension or termination of your Account.
1. Pinapayagang Paggamit
The FoxiFood platform is designed exclusively for legitimate restaurant, food service, and hospitality businesses. You may use the platform to:
- Create and manage an online ordering website for your restaurant or food service establishment;
- I-publish ang iyong menu, presyo, impormasyon sa allergen at detalye ng negosyo;
- Tumanggap at mag-proseso ng mga order ng pagkain at inumin mula sa iyong mga customer;
- Iproseso ang mga pagbabayad sa pamamagitan ng integrated payment gateway;
- Pamahalaan ang mga customer account, kasaysayan ng order at mga notification;
- Gumawa ng mga QR code para sa dine-in, takeaway at delivery ordering;
- Use the admin dashboard for analytics, order management, and business operations;
- Ikonekta ang sarili mong domain sa iyong ordering website.
2. Mga Ipinagbabawal na Aktibidad
Hindi mo maaaring gamitin ang FoxiFood platform para:
2.1. Iligal at Mapanganib na Aktibidad
- Sell, advertise, or distribute illegal or prohibited products or substances;
- Conduct any illegal business activities or facilitate illegal transactions;
- Magsagawa ng panloloko, money laundering o anumang uri ng financial crime;
- Magpadali ng tax evasion o gumawa ng mga pekeng invoice o resibo;
- Operate a business that does not comply with local food safety, health, and hygiene regulations.
2.2. Mga Paglabag sa Nilalaman
- Publish false, misleading, or deceptive menu information, pricing, or allergen data;
- Upload content that infringes on intellectual property rights of third parties (trademarks, copyrights, patents);
- Publish content that is defamatory, obscene, offensive, hateful, or discriminatory;
- Gumamit ng stock photo o larawan nang walang wastong lisensya;
- Magpanggap bilang ibang negosyo o magbigay ng maling representasyon ng iyong business identity;
- Mag-publish ng content na lumalabag sa mga batas sa content-regulation na naaangkop sa mga hurisdiksyon kung saan ka nag-ooperate (kabilang, para sa mga User sa European Union, ang EU Digital Services Act (Regulation (EU) 2022/2065) at national implementing legislation);
- Fail to respond to content complaints or notices from the Provider within the required timeframes set out in Section 5a of this policy.
2.3. Teknikal na Pag-abuso
- Attempt to gain unauthorized access to the platform's systems, servers, or networks;
- Reverse-engineer, decompile, or attempt to extract the source code of the platform;
- Use automated tools, bots, scrapers, or scripts to access the Service in a manner that exceeds normal use;
- Distribute malware, viruses, ransomware, or other malicious software through the platform;
- Perform denial-of-service attacks or intentionally degrade Service performance;
- Exploit security vulnerabilities without responsible disclosure to the Provider;
- Makagambala sa access o paggamit ng Serbisyo ng ibang mga User.
2.4. Maling Paggamit ng Platform
- Use the platform for any non-food-service business without prior written approval;
- Resell, sublicense, or share access to the platform with unauthorized third parties;
- Use the platform for sending unsolicited messages (spam) or bulk communications;
- Create multiple Accounts to circumvent usage limits, bans, or billing obligations;
- Use the platform to develop, test, or operate a competing product or service.
3. Mga Pamantayan ng Nilalaman
Lahat ng nilalaman na iyong ini-publish sa FoxiFood ay dapat:
- Maging tumpak, totoo at hindi mapanlinlang;
- Comply with applicable food safety, consumer protection, and advertising regulations;
- Magsama ng tumpak na impormasyon tungkol sa allergen ayon sa naaangkop na batas;
- Gumamit lamang ng mga larawan at nilalaman na may karapatan kang i-publish;
- Hindi maglaman ng anumang nakatagong o mapanlinlang na elemento.
You are solely responsible for the accuracy and legality of all content published through your ordering website. The Provider does not pre-review or verify User content.
4. Mga Limitasyon sa Paggamit ng Resources
To ensure fair access for all Users, the following resource limits apply:
- Makatwirang mga limitasyon sa storage para sa mga larawan ng menu at media files;
- API rate limits ayon sa dokumentasyon ng Serbisyo;
- Mga limitasyon sa email notification bawat Account bawat araw.
Specific limits may vary by plan and are subject to change. The Provider will notify Users of any material changes to resource limits.
5. Pagsubaybay at Pagpapatupad
Inilalaan ng Provider ang karapatang:
- Subaybayan ang paggamit ng Serbisyo para sa pagsunod sa Patakarang ito;
- Mag-imbestiga ng mga ulat ng paglabag;
- Mag-isyu ng mga babala para sa maliliit o unang paglabag;
- Pansamantalang suspendihin ang access para sa imbestigasyon ng mga posibleng paglabag;
- Permanently terminate Accounts for serious, repeated, or willful violations;
- Alisin o i-disable ang nilalaman na lumalabag sa Patakarang ito;
- Report illegal activities to the appropriate law enforcement authorities.
Where possible, the Provider will provide notice before taking enforcement action, except in cases of serious violations requiring immediate response (e.g., illegal activity, security threats, harm to other Users).
6. Abiso at Aksyon (Pagsunod sa Nilalaman)
Nagpapatakbo ang Tagapagbigay ng worldwide notice-and-action mechanism para tugunan ang content na pinaghihinalaang illegal na naka-host sa platform (na, para sa content at mga User sa European Union, nagpapatupad din ng Regulation (EU) 2022/2065 (Digital Services Act)):

- Upon receipt of a valid notice, the Provider will promptly notify the affected User and provide details of the complaint;
- The User must respond to the Provider within 48 hours, either removing or modifying the content, or providing a substantiated explanation of why the content is lawful;
- If the User fails to respond within 48 hours, the Provider reserves the right to restrict access to or remove the allegedly illegal content;
- The User may contest the Provider's decision by submitting a counter-statement within 14 calendar days, explaining why the content should be restored;
- The Provider will review counter-statements diligently and notify the User of its decision within 30 calendar days.
Repeated failure to respond to content notices or persistent publication of illegal content constitutes a serious violation of this AUP and may result in immediate suspension or termination of the Account.
7. Pag-ulat ng mga Paglabag
If you become aware of any violation of this AUP, please report it to us at: support@foxi.food
Please include a description of the violation, the Account or website involved (if known), and any supporting evidence. We will investigate all reports and take appropriate action.
8. Mga Pagbabago sa Patakarang Ito
The Provider reserves the right to update this Acceptable Use Policy at any time. Changes will be communicated in accordance with Section 21.1 of the Terms of Service. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
