1. Użu Permess

The FoxiFood platform is designed exclusively for legitimate restaurant, food service, and hospitality businesses. You may use the platform to:

• Create and manage an online ordering website for your restaurant or food service establishment;
• Ippubblika l-menu, il-prezzijiet, l-informazzjoni dwar l-allerġeni u d-dettalji tan-negozju tiegħek;
• Aċċetta u pproċessa ordnijiet tal-ikel u x-xorb mill-klijenti tiegħek;
• Tipproċessa l-ħlasijiet permezz tal-gateway tal-ħlas integrat;
• Immaniġġja l-kontijiet tal-klijenti, l-istorja tal-ordnijiet u n-notifiki;
• Iġġenera kodiċijiet QR għal ordnijiet fuq il-post, ta' barra u bil-kunsinna;
• Use the admin dashboard for analytics, order management, and business operations;
• Aqbad id-dominju tiegħek mal-websajt tal-ordnijiet tiegħek.

2. Attivitajiet Projbiti

Ma tistax tuża l-pjattaforma FoxiFood biex:

2.1. Attivitajiet illegali u ta' ħsara

• Sell, advertise, or distribute illegal or prohibited products or substances;
• Conduct any illegal business activities or facilitate illegal transactions;
• Tidħol fi frodi, ħasil ta' flus jew kwalunkwe forma ta' reat finanzjarju;
• Tiffaċilita l-evażjoni tat-taxxa jew toħloq fatturi jew irċevuti frawdolenti;
• Operate a business that does not comply with local food safety, health, and hygiene regulations.

2.2. Ksur tal-Kontenut

• Publish false, misleading, or deceptive menu information, pricing, or allergen data;
• Upload content that infringes on intellectual property rights of third parties (trademarks, copyrights, patents);
• Publish content that is defamatory, obscene, offensive, hateful, or discriminatory;

• Fail to respond to content complaints or notices from the Provider within the required timeframes set out in Section 5a of this policy.

2.3. Abbuż Tekniku

• Attempt to gain unauthorized access to the platform's systems, servers, or networks;
• Reverse-engineer, decompile, or attempt to extract the source code of the platform;
• Use automated tools, bots, scrapers, or scripts to access the Service in a manner that exceeds normal use;
• Distribute malware, viruses, ransomware, or other malicious software through the platform;
• Perform denial-of-service attacks or intentionally degrade Service performance;
• Exploit security vulnerabilities without responsible disclosure to the Provider;
• Tinterferixxi mal-aċċess jew l-użu tas-Servizz minn utenti oħra.

2.4. Użu Ħażin tal-Pjattaforma

• Use the platform for any non-food-service business without prior written approval;
• Resell, sublicense, or share access to the platform with unauthorized third parties;
• Use the platform for sending unsolicited messages (spam) or bulk communications;
• Create multiple Accounts to circumvent usage limits, bans, or billing obligations;
• Use the platform to develop, test, or operate a competing product or service.

3. Standards tal-Kontenut

• Comply with applicable food safety, consumer protection, and advertising regulations;

• Ma jkollux elementi moħbija jew qarrieqa.

You are solely responsible for the accuracy and legality of all content published through your ordering website. The Provider does not pre-review or verify User content.

4. Limiti tal-Użu tar-Riżorsi

To ensure fair access for all Users, the following resource limits apply:

• Limiti raġonevoli ta' ħażna għal immaġini tal-menu u fajls tal-midja;
• Limiti tar-rati tal-API kif dokumentat fid-dokumentazzjoni tas-Servizz;
• Limiti ta' notifiki bl-email għal kull kont kuljum.

Specific limits may vary by plan and are subject to change. The Provider will notify Users of any material changes to resource limits.

5. Monitoraġġ u Infurzar

Il-Fornitur jirriserva d-dritt li:

• Jimmonitorja l-użu tas-Servizz għall-konformità ma' din il-Politika;
• Jinvestiga rapporti ta' ksur;
• Joħroġ twissijiet għal ksur żgħir jew tal-ewwel darba;
• Jissospendi temporanjament l-aċċess għall-investigazzjoni ta' ksur possibbli;
• Permanently terminate Accounts for serious, repeated, or willful violations;
• Ineħħi jew jiddiżabilita kontenut li jikser din il-Politika;
• Report illegal activities to the appropriate law enforcement authorities.

Where possible, the Provider will provide notice before taking enforcement action, except in cases of serious violations requiring immediate response (e.g., illegal activity, security threats, harm to other Users).

6. Avviż u Azzjoni (Konformità tal-Kontenut)

Il-Fornitur jopera mekkaniżmu dinji ta' notifika u azzjoni (notice-and-action) biex jindirizza kontenut allegatament illegali ospitat fuq il-pjattaforma (li, għall-kontenut u l-Utenti fl-Unjoni Ewropea, jimplimenta wkoll ir-Regolament (UE) 2022/2065 (l-Att dwar is-Servizzi Diġitali)):

• Kwalunkwe persuna jew awtorità tista' tissottometti avviż lill-Fornitur dwar kontenut fuq is-sit tal-ordnijiet ta' Utent li hija tqis illegali skont il-liġi applikabbli għal dak il-kontenut;
• Upon receipt of a valid notice, the Provider will promptly notify the affected User and provide details of the complaint;
• The User must respond to the Provider within 48 hours, either removing or modifying the content, or providing a substantiated explanation of why the content is lawful;
• If the User fails to respond within 48 hours, the Provider reserves the right to restrict access to or remove the allegedly illegal content;
• The User may contest the Provider's decision by submitting a counter-statement within 14 calendar days, explaining why the content should be restored;
• The Provider will review counter-statements diligently and notify the User of its decision within 30 calendar days.

Repeated failure to respond to content notices or persistent publication of illegal content constitutes a serious violation of this AUP and may result in immediate suspension or termination of the Account.

7. Rappurtar ta' Ksur

If you become aware of any violation of this AUP, please report it to us at: support@foxi.food

Please include a description of the violation, the Account or website involved (if known), and any supporting evidence. We will investigate all reports and take appropriate action.

8. Bidliet f'din il-Politika

The Provider reserves the right to update this Acceptable Use Policy at any time. Changes will be communicated in accordance with Section 21.1 of the Terms of Service. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
