Ti posebni pogoji za posamezno državo dopolnjujejo Pogoje uporabe FoxiFood, politiko zasebnosti in druge splošne pravne dokumente za restavracijske partnerje (uporabnike) in končne stranke s sedežem oziroma prebivališčem v državi Slovenija. V primeru neskladja imajo ti posebni pogoji za posamezno državo prednost za uporabnike v državi Slovenija.
1. Operater platforme
Platforma FoxiFood je last družbe Elite Digital Services, LLC, ustanovljene v Združenih državah Amerike z registriranim sedežem na naslovu 1111B S Governors Ave #21653, Dover, DE 19904, USA, ki jo tudi upravlja po vsem svetu. Ponudnik izvaja storitev izključno na domenah foxifood.com in foxi.food.
Druge domene ali lokalne oziroma nacionalne različice platforme lahko upravljajo ločeni pravni subjekti na podlagi ločene licenčne pogodbe za uporabo blagovne znamke FOXIFOOD; taki subjekti delujejo v svojem imenu in na lastno odgovornost ter niso stranka pogodbe med ponudnikom in uporabnikom.
2. Registracija in razpoložljivost
Restavracije in gostinska podjetja s sedežem v državi Slovenija se lahko registrirajo za uporabo storitve in jo uporabljajo. Storitev se zagotavlja iz Združenih držav Amerike na podlagi gostovanega modela programske opreme kot storitve; ponudnik nima podružnice ali poslovne enote v državi Slovenija.
3. Veljavno pravo in spori
Pogodbo ureja pravo zvezne države Delaware, ZDA, spori pa spadajo v pristojnost sodišč zvezne države Delaware, kot je določeno v razdelku 19 Pogojev uporabe. Nobena določba pogodbe uporabniku — ali, kjer je ustrezno, potrošniku — ne odvzema varstva tistih določb prava države Slovenija, od katerih ni mogoče odstopati s pogodbo.
Ker država Slovenija spada v Evropsko unijo oziroma Evropski gospodarski prostor, se lahko spori alternativno predložijo Osrednjemu okrožnemu sodišču Bude (Budai Központi Kerületi Bíróság) v Budimpešti na Madžarskem, kot je določeno v razdelku 19.4 Pogojev uporabe.
4. Davki
Vse cene so neto cene brez VAT (DDV) in vseh drugih veljavnih davkov. Ponudnik je družba s sedežem v Združenih državah Amerike; uporabnik je odgovoren za samoobdavčitev in prijavo VAT (DDV) ter vseh drugih davkov, veljavnih v državi Slovenija, tudi na podlagi pravil o obrnjeni davčni obveznosti ali uvoženih storitvah, ki veljajo za storitve, kupljene pri tujem ponudniku.
Za podjetja v državi Slovenija lahko veljajo tudi tax-verified invoices (davčno potrjevanje računov); skladnost s temi zahtevami glede fiskalizacije ali izdajanja računov je izključna odgovornost uporabnika.
5. Varstvo podatkov
Osebni podatki se obdelujejo v skladu z našo splošno politiko zasebnosti in pogodbo o obdelavi podatkov. Za uporabnike in končne stranke v državi Slovenija veljavni okvir varstva podatkov vključuje Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Act (ZVOP-2). Uporabnik ostaja upravljavec podatkov o naročilih svojih končnih strank in je odgovoren za skladnost z obveznostmi varstva podatkov, veljavnimi v državi Slovenija.
Okvir skladnosti za EU/EGP — vključno s predstavnikom v EU, imenovanim v skladu s členom 27 GDPR, in pristojnimi nadzornimi organi — je opisan na strani GDPR v razdelku Pravno na naši spletni strani.
6. Potrošniki
Kadar za uporabo sistema FOXI ID ali naročilne spletne strani restavracije s strani končne stranke veljajo obvezna pravila o varstvu potrošnikov države Slovenija, nobena določba pravnih dokumentov FoxiFood ne omejuje pravic, ki jih ta pravila podeljujejo in se jim ni mogoče odpovedati s pogodbo.
7. Jezik
Ti posebni pogoji za posamezno državo so na voljo v jeziku Slovenščina. Angleška različica vseh pravnih dokumentov FoxiFood ostaja merodajna različica; v primeru kakršnega koli neskladja med prevodom in angleško različico prevlada angleška različica.

These Country-Specific Terms supplement the FoxiFood Terms of Service, the Privacy Policy, and the other global legal documents for restaurant partners (Users) and end customers based in Slovenia. In the event of a conflict, these Country-Specific Terms prevail for Users in Slovenia.
1. Platform Operator
The FoxiFood platform is owned and operated worldwide by Elite Digital Services, LLC, a company incorporated in the United States with its registered office at 1111B S Governors Ave #21653, Dover, DE 19904, USA. The Provider operates the Service exclusively at the domains foxifood.com and foxi.food.
Other domains or local or national versions of the platform may be operated by separate legal entities under a separate license agreement for the use of the FOXIFOOD trademark; such entities act in their own name and at their own responsibility and are not a party to the Agreement between the Provider and the User.
2. Registration and Availability
Restaurants and food businesses established in Slovenia may register for and use the Service. The Service is provided from the United States on a hosted software-as-a-service basis; the Provider does not maintain a branch or establishment in Slovenia.
3. Governing Law and Disputes
The Agreement is governed by the laws of the State of Delaware, USA, and disputes are subject to the jurisdiction of the courts of the State of Delaware, as set out in Section 19 of the Terms of Service. Nothing in the Agreement deprives the User — or, where applicable, a consumer — of the protection of those provisions of the law of Slovenia that cannot be derogated from by agreement.
Because Slovenia belongs to the European Union / European Economic Area, disputes may alternatively be brought before the Buda Central District Court (Budai Központi Kerületi Bíróság), Budapest, Hungary, as set out in Section 19.4 of the Terms of Service.
4. Taxes
All prices are net prices exclusive of VAT (DDV) and any other applicable taxes. The Provider is a United States company; the User is responsible for self-assessing and reporting VAT (DDV) and any other taxes applicable in Slovenia, including under any reverse-charge or imported-services rules that apply to services purchased from a foreign supplier.
Businesses in Slovenia may also be subject to tax-verified invoices (davčno potrjevanje računov); compliance with any such fiscalization or invoicing requirements is the sole responsibility of the User.
5. Data Protection
Personal data is processed in accordance with our global Privacy Policy and Data Processing Agreement. For Users and end customers in Slovenia, the applicable data protection framework includes Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Act (ZVOP-2). The User remains the data controller for its end customers' order data and is responsible for compliance with the data protection obligations applicable in Slovenia.
The EU/EEA compliance framework — including the EU representative appointed under Article 27 GDPR and the competent supervisory authorities — is described on the GDPR page in the Legal section of our website.
6. Consumers
Where the mandatory consumer protection rules of Slovenia apply to an end customer's use of FOXI ID or of a restaurant's ordering website, nothing in the FoxiFood legal documents limits any rights granted by those rules that cannot be waived by agreement.
7. Language
These Country-Specific Terms are provided in Slovenian. The English version of all FoxiFood legal documents remains the authoritative version; in the event of any discrepancy between a translation and the English version, the English version prevails.
