Pravila prihvatljive upotrebe

1. Dopuštena uporaba

The FoxiFood platform is designed exclusively for legitimate restaurant, food service, and hospitality businesses. You may use the platform to:

• Create and manage an online ordering website for your restaurant or food service establishment;
• Objavite svoj jelovnik, cijene, informacije o alergenima i poslovne podatke;
• Prihvaćajte i obrađujte narudžbe hrane i pića od svojih kupaca;
• Obrađivati plaćanja putem integriranog platnog pristupnika;
• Upravljajte korisničkim računima, poviješću narudžbi i obavijestima;
• Generirajte QR kodove za naručivanje na licu mjesta, za van i s dostavom;
• Use the admin dashboard for analytics, order management, and business operations;
• Povežite vlastitu domenu sa svojom web stranicom za naručivanje.

2. Zabranjene aktivnosti

Ne smijete koristiti platformu FoxiFood za:

2.1. Nezakonite i štetne aktivnosti

• Sell, advertise, or distribute illegal or prohibited products or substances;
• Conduct any illegal business activities or facilitate illegal transactions;
• Sudjelovanje u prijevarama, pranju novca ili bilo kojem obliku financijskog kriminala;
• Olakšavanje utaje poreza ili stvaranje lažnih faktura ili računa;
• Operate a business that does not comply with local food safety, health, and hygiene regulations.

2.2. Kršenja sadržaja

• Publish false, misleading, or deceptive menu information, pricing, or allergen data;
• Upload content that infringes on intellectual property rights of third parties (trademarks, copyrights, patents);
• Publish content that is defamatory, obscene, offensive, hateful, or discriminatory;
• Korištenje stock fotografija ili slika bez odgovarajuće licence;
• Lažno predstavljanje kao drugi poslovni subjekt ili krivotvorenje poslovnog identiteta;
• Publish content that violates the EU Digital Services Act (Regulation (EU) 2022/2065) or any applicable national implementing legislation;
• Fail to respond to content complaints or notices from the Provider within the required timeframes set out in Section 5a of this policy.

2.3. Tehnička zlouporaba

• Attempt to gain unauthorized access to the platform's systems, servers, or networks;
• Reverse-engineer, decompile, or attempt to extract the source code of the platform;
• Use automated tools, bots, scrapers, or scripts to access the Service in a manner that exceeds normal use;
• Distribute malware, viruses, ransomware, or other malicious software through the platform;
• Perform denial-of-service attacks or intentionally degrade Service performance;
• Exploit security vulnerabilities without responsible disclosure to the Provider;

2.4. Zlouporaba platforme

• Use the platform for any non-food-service business without prior written approval;
• Resell, sublicense, or share access to the platform with unauthorized third parties;
• Use the platform for sending unsolicited messages (spam) or bulk communications;
• Create multiple Accounts to circumvent usage limits, bans, or billing obligations;
• Use the platform to develop, test, or operate a competing product or service.

3. Standardi sadržaja

Sav sadržaj koji objavljujete putem FoxiFooda mora:

• Biti točan, istinit i ne zavaravajući;
• Comply with applicable food safety, consumer protection, and advertising regulations;
• Uključivati točne informacije o alergenima prema zahtjevima primjenjivog zakona;
• Koristiti samo slike i sadržaj za koje imate pravo objavljivanja;
• Ne sadržavati skrivene ili obmanjujuće elemente.

You are solely responsible for the accuracy and legality of all content published through your ordering website. The Provider does not pre-review or verify User content.

4. Ograničenja korištenja resursa

To ensure fair access for all Users, the following resource limits apply:

• Razumna ograničenja pohrane za slike jelovnika i medijske datoteke;
• Ograničenja API zahtjeva kako je dokumentirano u dokumentaciji Usluge;
• Ograničenja obavijesti e-poštom po računu na dan.

Specific limits may vary by plan and are subject to change. The Provider will notify Users of any material changes to resource limits.

5. Nadzor i provedba

Pružatelj zadržava pravo da:

• Prati korištenje Usluge radi usklađenosti s ovom Politikom;
• Istražuje prijave kršenja;
• Izdaje upozorenja za manja ili prvotna kršenja;
• Privremeno obustavi pristup radi istrage mogućih kršenja;
• Permanently terminate Accounts for serious, repeated, or willful violations;
• Ukloni ili onemogući sadržaj koji krši ovu Politiku;
• Report illegal activities to the appropriate law enforcement authorities.

Where possible, the Provider will provide notice before taking enforcement action, except in cases of serious violations requiring immediate response (e.g., illegal activity, security threats, harm to other Users).

6. Obavijest i radnja (Usklađenost sadržaja)

In accordance with Regulation (EU) 2022/2065 (Digital Services Act), the Provider operates a notice-and-action mechanism for addressing allegedly illegal content hosted on the platform:

• Any person or authority may submit a notice to the Provider regarding content on a User's ordering website that they consider to be illegal under applicable EU or national law;
• Upon receipt of a valid notice, the Provider will promptly notify the affected User and provide details of the complaint;
• The User must respond to the Provider within 48 hours, either removing or modifying the content, or providing a substantiated explanation of why the content is lawful;
• If the User fails to respond within 48 hours, the Provider reserves the right to restrict access to or remove the allegedly illegal content;
• The User may contest the Provider's decision by submitting a counter-statement within 14 calendar days, explaining why the content should be restored;
• The Provider will review counter-statements diligently and notify the User of its decision within 30 calendar days.

Repeated failure to respond to content notices or persistent publication of illegal content constitutes a serious violation of this AUP and may result in immediate suspension or termination of the Account.

7. Prijavljivanje kršenja

If you become aware of any violation of this AUP, please report it to us at: support@foxi.food

Please include a description of the violation, the Account or website involved (if known), and any supporting evidence. We will investigate all reports and take appropriate action.

8. Promjene ove Politike

The Provider reserves the right to update this Acceptable Use Policy at any time. Changes will be communicated in accordance with Section 21.1 of the Terms of Service. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
