Dessa landsspecifika villkor kompletterar FoxiFoods användarvillkor, integritetspolicy och övriga globala juridiska dokument för restaurangpartner (användare) och slutkunder baserade i Sverige. Vid en eventuell konflikt har dessa landsspecifika villkor företräde för användare i Sverige.
1. Plattformsoperatör
FoxiFood-plattformen ägs och drivs världen över av Elite Digital Services, LLC, ett bolag registrerat i USA med säte på 1111B S Governors Ave #21653, Dover, DE 19904, USA. Leverantören driver tjänsten uteslutande på domänerna foxifood.com och foxi.food.
Andra domäner eller lokala eller nationella versioner av plattformen kan drivas av separata juridiska enheter enligt ett separat licensavtal för användning av varumärket FOXIFOOD; sådana enheter agerar i eget namn och på eget ansvar och är inte part i avtalet mellan leverantören och användaren.
2. Registrering och tillgänglighet
Restauranger och livsmedelsföretag etablerade i Sverige får registrera sig för och använda tjänsten. Tjänsten tillhandahålls från USA på hostad SaaS-basis (software-as-a-service); leverantören har ingen filial eller etablering i Sverige.
3. Tillämplig lag och tvister
Avtalet regleras av lagarna i delstaten Delaware, USA, och tvister omfattas av domstolarna i delstaten Delawares behörighet, i enlighet med vad som anges i avsnitt 19 i användarvillkoren. Ingenting i avtalet fråntar användaren — eller, i förekommande fall, en konsument — det skydd som ges av de bestämmelser i lagen i Sverige som inte kan avtalas bort.
Eftersom Sverige tillhör Europeiska unionen/Europeiska ekonomiska samarbetsområdet kan tvister alternativt väckas vid Buda centrala distriktsdomstol (Budai Központi Kerületi Bíróság), Budapest, Ungern, i enlighet med vad som anges i avsnitt 19.4 i användarvillkoren.
4. Skatter
Alla priser är nettopriser exklusive VAT (moms) och eventuella andra tillämpliga skatter. Leverantören är ett amerikanskt bolag; användaren ansvarar själv för att fastställa och redovisa VAT (moms) och eventuella andra skatter som är tillämpliga i Sverige, inklusive enligt regler om omvänd betalningsskyldighet eller importerade tjänster som gäller för tjänster som köps från en utländsk leverantör.
Företag i Sverige kan även omfattas av certified cash registers (certifierat kassaregister); efterlevnad av sådana krav på fiskalisering eller fakturering är helt och hållet användarens ansvar.
5. Dataskydd
Personuppgifter behandlas i enlighet med vår globala integritetspolicy och vårt personuppgiftsbiträdesavtal. För användare och slutkunder i Sverige omfattar det tillämpliga dataskyddsregelverket Regulation (EU) 2016/679 (GDPR) and the Swedish Data Protection Act (2018:218). Användaren förblir personuppgiftsansvarig för sina slutkunders orderuppgifter och ansvarar för efterlevnaden av de dataskyddsskyldigheter som är tillämpliga i Sverige.

6. Konsumenter
När de tvingande konsumentskyddsreglerna i Sverige är tillämpliga på en slutkunds användning av FOXI ID eller av en restaurangs beställningswebbplats, begränsar ingenting i FoxiFoods juridiska dokument de rättigheter som följer av dessa regler och som inte kan avstås genom avtal.
7. Språk
Dessa landsspecifika villkor tillhandahålls på svenska. Den engelska versionen av samtliga FoxiFoods juridiska dokument förblir den auktoritativa versionen; vid eventuell avvikelse mellan en översättning och den engelska versionen ska den engelska versionen ha företräde.

English version (authoritative)
These Country-Specific Terms supplement the FoxiFood Terms of Service, the Privacy Policy, and the other global legal documents for restaurant partners (Users) and end customers based in Sweden. In the event of a conflict, these Country-Specific Terms prevail for Users in Sweden.
1. Platform Operator
The FoxiFood platform is owned and operated worldwide by Elite Digital Services, LLC, a company incorporated in the United States with its registered office at 1111B S Governors Ave #21653, Dover, DE 19904, USA. The Provider operates the Service exclusively at the domains foxifood.com and foxi.food.
Other domains or local or national versions of the platform may be operated by separate legal entities under a separate license agreement for the use of the FOXIFOOD trademark; such entities act in their own name and at their own responsibility and are not a party to the Agreement between the Provider and the User.
2. Registration and Availability
Restaurants and food businesses established in Sweden may register for and use the Service. The Service is provided from the United States on a hosted software-as-a-service basis; the Provider does not maintain a branch or establishment in Sweden.
3. Governing Law and Disputes
The Agreement is governed by the laws of the State of Delaware, USA, and disputes are subject to the jurisdiction of the courts of the State of Delaware, as set out in Section 19 of the Terms of Service. Nothing in the Agreement deprives the User — or, where applicable, a consumer — of the protection of those provisions of the law of Sweden that cannot be derogated from by agreement.
Because Sweden belongs to the European Union / European Economic Area, disputes may alternatively be brought before the Buda Central District Court (Budai Központi Kerületi Bíróság), Budapest, Hungary, as set out in Section 19.4 of the Terms of Service.
4. Taxes
All prices are net prices exclusive of VAT (moms) and any other applicable taxes. The Provider is a United States company; the User is responsible for self-assessing and reporting VAT (moms) and any other taxes applicable in Sweden, including under any reverse-charge or imported-services rules that apply to services purchased from a foreign supplier.
Businesses in Sweden may also be subject to certified cash registers (certifierat kassaregister); compliance with any such fiscalization or invoicing requirements is the sole responsibility of the User.
5. Data Protection
Personal data is processed in accordance with our global Privacy Policy and Data Processing Agreement. For Users and end customers in Sweden, the applicable data protection framework includes Regulation (EU) 2016/679 (GDPR) and the Swedish Data Protection Act (2018:218). The User remains the data controller for its end customers' order data and is responsible for compliance with the data protection obligations applicable in Sweden.

6. Consumers
Where the mandatory consumer protection rules of Sweden apply to an end customer's use of FOXI ID or of a restaurant's ordering website, nothing in the FoxiFood legal documents limits any rights granted by those rules that cannot be waived by agreement.
7. Language
These Country-Specific Terms are provided in Swedish. The English version of all FoxiFood legal documents remains the authoritative version; in the event of any discrepancy between a translation and the English version, the English version prevails.
