Þessir landssértæku skilmálar eru til viðbótar við þjónustuskilmála FoxiFood, persónuverndarstefnuna og önnur alþjóðleg lagaskjöl fyrir samstarfsveitingastaði (Notendur) og endanlega viðskiptavini með staðfestu í Ísland. Komi upp árekstur gilda þessir landssértæku skilmálar fyrir Notendur í Ísland.
1. Rekstraraðili vettvangs
FoxiFood-vettvangurinn er í eigu og rekstri Elite Digital Services, LLC, um allan heim, en fyrirtækið er stofnað í Bandaríkjunum með skráða skrifstofu að 1111B S Governors Ave #21653, Dover, DE 19904, USA. Þjónustuveitandinn rekur Þjónustuna eingöngu á lénunum foxifood.com og foxi.food.
Önnur lén eða staðbundnar eða þjóðlegar útgáfur af vettvanginum geta verið reknar af sjálfstæðum lögaðilum samkvæmt sérstökum leyfissamningi um notkun FOXIFOOD-vörumerkisins; slíkir aðilar starfa í eigin nafni og á eigin ábyrgð og eru ekki aðilar að Samningnum milli Þjónustuveitandans og Notandans.
2. Skráning og framboð
Veitingastaðir og matvælafyrirtæki með staðfestu í Ísland geta skráð sig fyrir og notað Þjónustuna. Þjónustan er veitt frá Bandaríkjunum á grundvelli hýsts hugbúnaðar sem þjónustu (SaaS); Þjónustuveitandinn hefur ekki útibú eða starfsstöð í Ísland.
3. Gildandi lög og ágreiningsmál
Um Samninginn gilda lög Delaware-ríkis í Bandaríkjunum og ágreiningsmál heyra undir lögsögu dómstóla Delaware-ríkis, eins og fram kemur í 19. grein þjónustuskilmálanna. Ekkert í Samningnum sviptir Notandann — eða, eftir því sem við á, neytanda — vernd þeirra ákvæða laga Ísland sem ekki er hægt að víkja frá með samningi.
Þar sem Ísland tilheyrir Evrópusambandinu / Evrópska efnahagssvæðinu er einnig hægt að leggja ágreiningsmál fyrir Héraðsdóm Buda-héraðs (Budai Központi Kerületi Bíróság) í Búdapest í Ungverjalandi, eins og fram kemur í grein 19.4 í þjónustuskilmálunum.
4. Skattar
Allt verð er nettóverð, án VAT (VSK) og annarra gildandi skatta. Þjónustuveitandinn er bandarískt fyrirtæki; Notandinn ber ábyrgð á að meta sjálfur og telja fram VAT (VSK) og aðra skatta sem gilda í Ísland, þar á meðal samkvæmt reglum um öfuga skattlagningu (reverse-charge) eða innflutta þjónustu sem gilda um þjónustu sem keypt er af erlendum birgi.
5. Persónuvernd
Persónuupplýsingar eru unnar í samræmi við alþjóðlega persónuverndarstefnu okkar og vinnslusamning um persónuupplýsingar (DPA). Fyrir Notendur og endanlega viðskiptavini í Ísland felur gildandi persónuverndarrammi í sér Regulation (EU) 2016/679 (GDPR, as incorporated into the EEA Agreement) and Act No. 90/2018 on Data Protection. Notandinn er áfram ábyrgðaraðili gagna varðandi pöntunargögn endanlegra viðskiptavina sinna og ber ábyrgð á að farið sé að þeim persónuverndarskyldum sem gilda í Ísland.
Regluvörslurammi ESB/EES — þar á meðal fulltrúi ESB sem skipaður er samkvæmt 27. grein GDPR og lögbær eftirlitsyfirvöld — er lýst á GDPR-síðunni í lagahluta vefsíðu okkar.
6. Neytendur
Þar sem ófrávíkjanlegar neytendaverndarreglur Ísland gilda um notkun endanlegs viðskiptavinar á FOXI ID eða pöntunarvefsíðu veitingastaðar, takmarkar ekkert í lagaskjölum FoxiFood þau réttindi sem þær reglur veita og ekki er hægt að afsala sér með samningi.
7. Tungumál
Þessir landssértæku skilmálar eru veittir á Íslenska. Enska útgáfan af öllum lagalegum skjölum FoxiFood er áfram gildandi útgáfa; komi upp misræmi milli þýðingar og ensku útgáfunnar gildir enska útgáfan.

English version (authoritative)
These Country-Specific Terms supplement the FoxiFood Terms of Service, the Privacy Policy, and the other global legal documents for restaurant partners (Users) and end customers based in Iceland. In the event of a conflict, these Country-Specific Terms prevail for Users in Iceland.
1. Platform Operator
The FoxiFood platform is owned and operated worldwide by Elite Digital Services, LLC, a company incorporated in the United States with its registered office at 1111B S Governors Ave #21653, Dover, DE 19904, USA. The Provider operates the Service exclusively at the domains foxifood.com and foxi.food.
Other domains or local or national versions of the platform may be operated by separate legal entities under a separate license agreement for the use of the FOXIFOOD trademark; such entities act in their own name and at their own responsibility and are not a party to the Agreement between the Provider and the User.
2. Registration and Availability
Restaurants and food businesses established in Iceland may register for and use the Service. The Service is provided from the United States on a hosted software-as-a-service basis; the Provider does not maintain a branch or establishment in Iceland.
3. Governing Law and Disputes
The Agreement is governed by the laws of the State of Delaware, USA, and disputes are subject to the jurisdiction of the courts of the State of Delaware, as set out in Section 19 of the Terms of Service. Nothing in the Agreement deprives the User — or, where applicable, a consumer — of the protection of those provisions of the law of Iceland that cannot be derogated from by agreement.
Because Iceland belongs to the European Union / European Economic Area, disputes may alternatively be brought before the Buda Central District Court (Budai Központi Kerületi Bíróság), Budapest, Hungary, as set out in Section 19.4 of the Terms of Service.
4. Taxes
All prices are net prices exclusive of VAT (VSK) and any other applicable taxes. The Provider is a United States company; the User is responsible for self-assessing and reporting VAT (VSK) and any other taxes applicable in Iceland, including under any reverse-charge or imported-services rules that apply to services purchased from a foreign supplier.
5. Data Protection
Personal data is processed in accordance with our global Privacy Policy and Data Processing Agreement. For Users and end customers in Iceland, the applicable data protection framework includes Regulation (EU) 2016/679 (GDPR, as incorporated into the EEA Agreement) and Act No. 90/2018 on Data Protection. The User remains the data controller for its end customers' order data and is responsible for compliance with the data protection obligations applicable in Iceland.

6. Consumers
Where the mandatory consumer protection rules of Iceland apply to an end customer's use of FOXI ID or of a restaurant's ordering website, nothing in the FoxiFood legal documents limits any rights granted by those rules that cannot be waived by agreement.
7. Language
These Country-Specific Terms are provided in Icelandic. The English version of all FoxiFood legal documents remains the authoritative version; in the event of any discrepancy between a translation and the English version, the English version prevails.
