Ovi Uslovi specifični za zemlju dopunjuju FoxiFood Uslove korišćenja, Politiku privatnosti i ostale globalne pravne dokumente za restoranske partnere (Korisnike) i krajnje kupce sa sedištem u zemlji Srbija. U slučaju sukoba, ovi Uslovi specifični za zemlju imaju prednost za Korisnike u zemlji Srbija.
1. Operator platforme
FoxiFood platforma je u vlasništvu i pod upravom kompanije Elite Digital Services, LLC, kompanije osnovane u Sjedinjenim Američkim Državama sa sedištem na adresi 1111B S Governors Ave #21653, Dover, DE 19904, USA, širom sveta. Pružalac pruža Uslugu isključivo na domenima foxifood.com i foxi.food.
Druge domene ili lokalne ili nacionalne verzije platforme mogu voditi zasebni pravni subjekti na osnovu posebnog ugovora o licenci za korišćenje žiga FOXIFOOD; takvi subjekti deluju u svoje ime i na sopstvenu odgovornost i nisu strana u Ugovoru između Pružaoca i Korisnika.
2. Registracija i dostupnost
Restorani i subjekti iz oblasti hrane sa sedištem u zemlji Srbija mogu se registrovati za Uslugu i koristiti je. Usluga se pruža iz Sjedinjenih Američkih Država na osnovu hostovanog modela softvera kao usluge; Pružalac nema ogranak niti poslovnu jedinicu u zemlji Srbija.
3. Merodavno pravo i sporovi
Ugovor je uređen pravom savezne države Delaver, SAD, a sporovi su u nadležnosti sudova savezne države Delaver, kako je predviđeno u odeljku 19 Uslova korišćenja. Ništa u Ugovoru ne uskraćuje Korisniku — ili, gde je primenjivo, potrošaču — zaštitu onih odredbi prava zemlje Srbija od kojih se ugovorom ne može odstupiti.
4. Porezi
Sve cene su neto cene, bez VAT (PDV) i svih drugih primenjivih poreza. Pružalac je kompanija sa sedištem u Sjedinjenim Američkim Državama; Korisnik je odgovoran za samostalno obračunavanje i prijavljivanje VAT (PDV) i svih drugih poreza koji se primenjuju u zemlji Srbija, uključujući pravila o prenosu poreske obaveze (reverse-charge) ili o uvezenim uslugama koja se primenjuju na usluge kupljene od stranog dobavljača.
Poslovni subjekti u zemlji Srbija takođe mogu podlegati electronic fiscalization of receipts (eFiskalizacija); usklađenost sa svim takvim zahtevima u pogledu fiskalizacije ili fakturisanja isključiva je odgovornost Korisnika.
5. Zaštita podataka
Lični podaci se obrađuju u skladu sa našom globalnom Politikom privatnosti i Ugovorom o obradi podataka. Za Korisnike i krajnje kupce u zemlji Srbija, primenjivi okvir zaštite podataka obuhvata the Law on Personal Data Protection (Zakon o zaštiti podataka o ličnosti, 2018). Korisnik ostaje rukovalac podataka za podatke o narudžbinama svojih krajnjih kupaca i odgovoran je za usklađenost sa obavezama zaštite podataka koje se primenjuju u zemlji Srbija.
6. Potrošači
Kada se obavezna pravila o zaštiti potrošača zemlje Srbija primenjuju na korišćenje FOXI ID naloga ili veb sajta za narudžbine restorana od strane krajnjeg kupca, ništa u FoxiFood pravnim dokumentima ne ograničava prava dodeljena tim pravilima od kojih se ugovorom ne može odustati.
7. Jezik
Ovi Uslovi specifični za zemlju dostupni su na sledećem jeziku: српски. Verzija na engleskom jeziku svih FoxiFood pravnih dokumenata ostaje merodavna verzija; u slučaju bilo kakvog neslaganja između prevoda i verzije na engleskom jeziku, prevagu ima verzija na engleskom jeziku.

These Country-Specific Terms supplement the FoxiFood Terms of Service, the Privacy Policy, and the other global legal documents for restaurant partners (Users) and end customers based in Serbia. In the event of a conflict, these Country-Specific Terms prevail for Users in Serbia.
1. Platform Operator
The FoxiFood platform is owned and operated worldwide by Elite Digital Services, LLC, a company incorporated in the United States with its registered office at 1111B S Governors Ave #21653, Dover, DE 19904, USA. The Provider operates the Service exclusively at the domains foxifood.com and foxi.food.
Other domains or local or national versions of the platform may be operated by separate legal entities under a separate license agreement for the use of the FOXIFOOD trademark; such entities act in their own name and at their own responsibility and are not a party to the Agreement between the Provider and the User.
2. Registration and Availability
Restaurants and food businesses established in Serbia may register for and use the Service. The Service is provided from the United States on a hosted software-as-a-service basis; the Provider does not maintain a branch or establishment in Serbia.
3. Governing Law and Disputes
The Agreement is governed by the laws of the State of Delaware, USA, and disputes are subject to the jurisdiction of the courts of the State of Delaware, as set out in Section 19 of the Terms of Service. Nothing in the Agreement deprives the User — or, where applicable, a consumer — of the protection of those provisions of the law of Serbia that cannot be derogated from by agreement.
4. Taxes
All prices are net prices exclusive of VAT (PDV) and any other applicable taxes. The Provider is a United States company; the User is responsible for self-assessing and reporting VAT (PDV) and any other taxes applicable in Serbia, including under any reverse-charge or imported-services rules that apply to services purchased from a foreign supplier.
Businesses in Serbia may also be subject to electronic fiscalization of receipts (eFiskalizacija); compliance with any such fiscalization or invoicing requirements is the sole responsibility of the User.
5. Data Protection
Personal data is processed in accordance with our global Privacy Policy and Data Processing Agreement. For Users and end customers in Serbia, the applicable data protection framework includes the Law on Personal Data Protection (Zakon o zaštiti podataka o ličnosti, 2018). The User remains the data controller for its end customers' order data and is responsible for compliance with the data protection obligations applicable in Serbia.
6. Consumers
Where the mandatory consumer protection rules of Serbia apply to an end customer's use of FOXI ID or of a restaurant's ordering website, nothing in the FoxiFood legal documents limits any rights granted by those rules that cannot be waived by agreement.
7. Language
These Country-Specific Terms are provided in Serbian. The English version of all FoxiFood legal documents remains the authoritative version; in the event of any discrepancy between a translation and the English version, the English version prevails.
