Këto Kushte Specifike për Vendin plotësojnë Kushtet e Shërbimit të FoxiFood, Politikën e Privatësisë, dhe dokumentet e tjera ligjore globale për partnerët restorant (Përdoruesit) dhe klientët fundorë me bazë në Shqipëria. Në rast konflikti, këto Kushte Specifike për Vendin mbizotërojnë për Përdoruesit në Shqipëria.
1. Operatori i Platformës
Platforma FoxiFood zotërohet dhe operohet në mbarë botën nga Elite Digital Services, LLC, një kompani e regjistruar në Shtetet e Bashkuara me seli të regjistruar në 1111B S Governors Ave #21653, Dover, DE 19904, USA. Ofruesi e operon Shërbimin ekskluzivisht në domenet foxifood.com dhe foxi.food.
Domene të tjera ose versione lokale apo kombëtare të platformës mund të operohen nga subjekte të veçanta ligjore sipas një marrëveshjeje të veçantë licence për përdorimin e markës tregtare FOXIFOOD; këto subjekte veprojnë në emrin dhe përgjegjësinë e tyre dhe nuk janë palë në Marrëveshjen ndërmjet Ofruesit dhe Përdoruesit.
2. Regjistrimi dhe Disponueshmëria
Restorantet dhe bizneset ushqimore të themeluara në Shqipëria mund të regjistrohen dhe të përdorin Shërbimin. Shërbimi ofrohet nga Shtetet e Bashkuara mbi bazën e softuerit si shërbim (SaaS) të pritur; Ofruesi nuk mban asnjë degë apo vendndodhje biznesi në Shqipëria.
3. E Drejta e Zbatueshme dhe Mosmarrëveshjet
Marrëveshja rregullohet nga ligjet e Shtetit të Delaware-it, SHBA, dhe mosmarrëveshjet i nënshtrohen juridiksionit të gjykatave të Shtetit të Delaware-it, siç përcaktohet në Seksionin 19 të Kushteve të Shërbimit. Asgjë në Marrëveshje nuk e privon Përdoruesin — ose, kur është e zbatueshme, një konsumator — nga mbrojtja e atyre dispozitave të ligjit të Shqipëria nga të cilat nuk mund të derogohet me marrëveshje.
4. Tatimet
Të gjitha çmimet janë çmime neto, pa përfshirë VAT (TVSH) dhe çdo tatim tjetër të zbatueshëm. Ofruesi është një kompani e Shteteve të Bashkuara; Përdoruesi është përgjegjës për vetëvlerësimin dhe raportimin e VAT (TVSH) dhe çdo tatimi tjetër të zbatueshëm në Shqipëria, përfshirë sipas çdo rregulli mbi ngarkesën e kundërt ose shërbimet e importuara që zbatohet për shërbimet e blera nga një furnizues i huaj.
Bizneset në Shqipëria mund t'i nënshtrohen gjithashtu electronic fiscalization of invoices; përmbushja e çdo kërkese të tillë fiskalizimi ose faturimi është përgjegjësi ekskluzive e Përdoruesit.
5. Mbrojtja e të Dhënave
Të dhënat personale përpunohen në përputhje me Politikën tonë globale të Privatësisë dhe Marrëveshjen e Përpunimit të të Dhënave. Për Përdoruesit dhe klientët fundorë në Shqipëria, kuadri i zbatueshëm për mbrojtjen e të dhënave përfshin the applicable Albanian data protection legislation. Përdoruesi mbetet kontrolluesi i të dhënave për të dhënat e porosive të klientëve të tij fundorë dhe është përgjegjës për përmbushjen e detyrimeve për mbrojtjen e të dhënave të zbatueshme në Shqipëria.
6. Konsumatorët
Kur rregullat e detyrueshme për mbrojtjen e konsumatorit të Shqipëria zbatohen për përdorimin nga një klient fundor të FOXI ID-së ose të faqes së internetit të porosive të një restoranti, asgjë në dokumentet ligjore të FoxiFood nuk kufizon ndonjë të drejtë të dhënë nga ato rregulla, nga e cila nuk mund të hiqet dorë me marrëveshje.
7. Gjuha
Këto Kushte Specifike për Vendin ofrohen në shqip. Versioni anglisht i të gjitha dokumenteve ligjore të FoxiFood mbetet versioni autoritativ; në rast mospërputhjeje ndërmjet një përkthimi dhe versionit anglisht, versioni anglisht mbizotëron.

English version (authoritative)
These Country-Specific Terms supplement the FoxiFood Terms of Service, the Privacy Policy, and the other global legal documents for restaurant partners (Users) and end customers based in Albania. In the event of a conflict, these Country-Specific Terms prevail for Users in Albania.
1. Platform Operator
The FoxiFood platform is owned and operated worldwide by Elite Digital Services, LLC, a company incorporated in the United States with its registered office at 1111B S Governors Ave #21653, Dover, DE 19904, USA. The Provider operates the Service exclusively at the domains foxifood.com and foxi.food.
Other domains or local or national versions of the platform may be operated by separate legal entities under a separate license agreement for the use of the FOXIFOOD trademark; such entities act in their own name and at their own responsibility and are not a party to the Agreement between the Provider and the User.
2. Registration and Availability
Restaurants and food businesses established in Albania may register for and use the Service. The Service is provided from the United States on a hosted software-as-a-service basis; the Provider does not maintain a branch or establishment in Albania.
3. Governing Law and Disputes
The Agreement is governed by the laws of the State of Delaware, USA, and disputes are subject to the jurisdiction of the courts of the State of Delaware, as set out in Section 19 of the Terms of Service. Nothing in the Agreement deprives the User — or, where applicable, a consumer — of the protection of those provisions of the law of Albania that cannot be derogated from by agreement.
4. Taxes
All prices are net prices exclusive of VAT (TVSH) and any other applicable taxes. The Provider is a United States company; the User is responsible for self-assessing and reporting VAT (TVSH) and any other taxes applicable in Albania, including under any reverse-charge or imported-services rules that apply to services purchased from a foreign supplier.
Businesses in Albania may also be subject to electronic fiscalization of invoices; compliance with any such fiscalization or invoicing requirements is the sole responsibility of the User.
5. Data Protection
Personal data is processed in accordance with our global Privacy Policy and Data Processing Agreement. For Users and end customers in Albania, the applicable data protection framework includes the applicable Albanian data protection legislation. The User remains the data controller for its end customers' order data and is responsible for compliance with the data protection obligations applicable in Albania.
6. Consumers
Where the mandatory consumer protection rules of Albania apply to an end customer's use of FOXI ID or of a restaurant's ordering website, nothing in the FoxiFood legal documents limits any rights granted by those rules that cannot be waived by agreement.
7. Language
These Country-Specific Terms are provided in Albanian. The English version of all FoxiFood legal documents remains the authoritative version; in the event of any discrepancy between a translation and the English version, the English version prevails.
